Waytha Moorthy misleading gov’t on root cause of Indian plight in Malaya

Waytha upbeat on PH effort to solve Indian woes

It’s not racist to stand up for your place in the sun.

It’s racist to deny anyone his or her place in the sun.

Mahathir should listen to me on the plight of the Indians in Malaya.

I asked Waytha Moorthy to let me represent Hindraf in the Cabinet. His answer was, “ayo, like this I would be unemployed!”.

I advised him to focus on Hindraf. He can criticise me as Minister.

I would have never accepted the post of Unity Minister. Anyone who holds this post can never speak up for Indians.

Waytha Moorthy and his elder brother Uthayakumar are misleading Mahathir on the root cause of the Indian plight.

Indians will urinate on Mahathir’s grave when he goes.

They will also urinate on the graves of Waytha Moorthy, Uthayakumar, and MIC leaders and Samy Vellu.

The distortion of Article 153, and NEP, and the existence of the Definition of Malay in Article 160 have hit Indians hard.

It’s unlikely that whoever is in Putrajaya will do anything for Indians.

The Definition of Malay in Article 160 and the distortion of Article 153 and the NEP stand in the way.

Indian votes are only important in bringing down a gov’t, and denying the gov’t two thirds majority, not to put one in power.

The incumbent gov’t does not need Indian votes to remain in power.

Indians in Malaya are condemned to bringing down the gov’t without getting anything in return.

Indians in Malaya should get their politics and relationships right.

That’s only possible if there’s a change in mindset.

Degenerating into rhetoric and polemics is not the way. That’s what MIC did for 60 years, what Waytha Moorthy is doing now and what Uthaya Kumar seems to be doing.

They should control the Narrative.

The politics of the so-called Malays is based on nothing but bullshit.

Indians should not emulate this.

They should emulate the Chinese in DAP.

No point demanding this and that as Indians. The gov’t will not entertain such demands.

Indians are not mentioned directly in the Constitution. There are 350, 000 stateless people of Indian origin in Malaya. A further 850, 000 displaced estate workers are of Indian origin.

Only the Orang Asal and so-called Malays are mentioned in the Constitution.

Indians should focus on Article 153.

The second prong mentions the legitimate interests/aspirations of non-Malays.

The first prong is about a reasonable proportion, by way of a special position for the Orang Asal and so-called Malays, in only four areas viz. intake into the civil service; intake into institutions of higher learning owned by the gov’t and training opportunities; gov’t scholarships; and opportunities from the gov’t to do business.

Giving 90 per cent of matriculation seats to the so-called Malays is an unreasonable proportion. The so-called Malays formed only 50.4 per cent of the population in 2010, the last time the census was taken.

Article 153 has been deviated and distorted from reasonable proportion in the said four areas, to unreasonable proportion in the four areas, to unreasonable proportion in all walks of life.

Examples abound. For example, the canteens in all Klinik Kesihatan are run by so-called Malays. During puasa month, these canteens are closed. Non-Malays visiting the clinics can’t get even a drink.

Indians in Malaya should focus on the deviations and distortions in the implementation of Article 153 and the NEP.

By focussing in this manner, Indians in Malaya can secure their legitimate interests/aspirations.

They have legitimate expectations.

Bankruptcy . . .

Once the Federal Gov’t goes bankrupt — i.e. unable to service debts — rotten politics will end.

The IMF, World Bank, the treasuries of the rich nations and India and China, and the UN have to come in.

Then, we will no longer hear about bangsa, agama, negara and derma.

We will no longer see anyone harping on Melayu, Melayu, Melayu, Islam, Islam, Islam, raja raja, raja raja, raja raja, bahasa Melayu, bahasa Melayu, bahasa Melayu, and pendatang, pendatang, pendatang.

The so-called Malays will deny their identity.

They will go back to their roots and racial heritage as Tamil, Malayalee, Pathan, Yemeni, and Turk (all from India); and Bugis, Javanese, Minang and Aceh (all from Indonesia).

North Borneo and Sarawak will exit their Federation with Malaya as the Federal Gov’t has been in non-compliance on the Malaysia Agreement (MA63).

Karmic forces have to exhaust themselves.

The so-called Malays have to face their karma.

Definition of Malay . . .

The rule of law, the basis of the Constitution, is not only about the letter of the law (tersurat) but the spirit of the law too (tersirat), with greater emphasis on the latter.

There were no Malays in Singapore and Malaya, in law, before the Definition of Malay in Article 160.

Before the Definition of Malay in Article 160, there were only various Muslim communities in Singapore and Malaya using Malay to communicate with each other. It was the British who referred to them by the administrative term, Malay.

The so-called Malays in Singapore and Malaya, under Article 160, did not exist in law until Merdeka.

Again, that’s in law.

The Definition of Malay . . .

Malaya does not belong to the so-called Malays defined in the Definition of Malay in Article 160.

The Definition is not about race, DNA, Valiangkati, Nathekaran, history, geographical origin, Nusantara, Kepulauan Melayu, rumpun Melayu or Austronesian.

It’s about a Bogus Malay identity for some Muslims governed by the Merdeka cutoff point. No more so-called Malays after Merdeka except for the descendants of the so-called Malays.

The Definition is an artificial construct, an aberration in law. The Constitution is colour blind.

If those who are not Malay hold “Malay” MyKads, they are holding fraudulent documents. If the so-called Malays accept Muslim non-Malays as so-called Malay, it does not mean they will get Malay MyKads.

We can just point at the Definition in Article 160 in Malaya and Article 152 in Singapore.

The law says that if you get something to which you are not entitled, and not eligible to hold, it does not exist in law, as if it never existed. The gov’t will deny being party to any illegality. The onus is on the MyKad holder to prove his or her case. The court won’t accept “the gov’t gave” as a defence.

The JPN will wash its hands on the matter.

Many people in Malaya may be holding fraudulent Malay MyKads.

Under Article 160, they are not eligible to hold Malay MyKads. Those who converted after Merdeka in Singapore and Malaya are not eligible to hold Malay MyKads.

If converts after Merdeka hold Malay MyKads, they are holding fraudulent documents.

Muslims, including Indonesians, who came to Singapore and Malaya after Merdeka are not Malays. If they hold Malay MyKads, they are holding fraudulent MyKads.

Zahid Hamidi, for example, reportedly came to Malaya from Java in 1965. He went on to become Umno deputy president and acting president. If he holds a Malay MyKad, he’s holding a fraudulent MyKad.

Half true . . .

There’s a misconception that any Tom, Dick and Harry, if Muslim, can be Malay in Singapore and Malaya.

This is only half true.

Any Tom, Dick and Harry can be Malay in Singapore and Malaya only before Merdeka, 31 Aug 1957.

The descendants of these Tom, Dick and Harry are also Malay.

According to the Definition of Malay in Article 160, Muslims able to speak Malay are Malay if born or domiciled in Singapore and Malaya by Merdeka, 31 Aug 1957.

Their descendants are Malay.

It’s unconstitutional to deny converts and Indian Muslims in Malaya, for example, “Malay” status if they qualify by the Merdeka cutoff point in Article 160. Their descendants are also Malay.

It’s clear from the Definition that Malays are not Orang Asal in Singapore and Malaya. They are pendatang either born locally and/or those who arrived before Merdeka. They are not Bumiputera.

Those who convert after Merdeka in Singapore and Malaya remain non-Malay. It’s not enough to be Muslim, speak Malay, and practise so-called Malay culture, customs and traditions to be Malay. There must be compliance with the cutoff point, Merdeka 31 Aug 1957.

The British gave a role to the sultans in Malaya as heads of Islam, and presiding over so-called Malay culture, customs and traditions.

Earlier, it was the British who stopped the toll collection, recognised and elevated the toll collectors and gave them an annual purse, and created the sultanates as territorial states named after the main waterways.

The British also created the Conference of Rulers, now redundant since Parliament convened in 1957.

The Definition covers only Singapore and Malaya.

Singapore has its own Definition under Article 152. Under the Definition in Singapore, the so-called Malays need not be Muslim i.e. they can leave Islam and still remain so-called Malay. This was after the Definition was amended in 1965 in line with the constitutional provision on freedom of conscience.

In Malaya, a Malay ceases to be Malay if he or she leaves Islam. This is unconstitutional.

So-called Malays who are wannabe Arabs cease to be so-called Malays under the Definition of Malay in Article 160.

The law is clear.

Islam . . .

The 3rd Caliph created Islam as an identity for Arabs. He compiled the Quran from Aramaic and sources in other languages and codified it.

There’s no reason for non-Arabs to be Muslim.

Again, a non-Muslim does not become so-called Malay in Malaya by embracing Islam after Merdeka.

The Definition of Malay in Article 160 does not cover Sabah and Sarawak.

Sarawak Malays are covered under Article 161A. They do not have NCR land. They are Orang Laut.

Article 161A does not mention any Malays in Sabah.

Article 161A states that only Indigenous people in Sabah and Sarawak are Natives.

When Uthaykumar was suffering in Prison,
    When Waythyamoorthy was doing hungerstrike
    Where was thou, Joseph?

    1. You ask them. I advised Uthayakumar how to avoid jail re the sedition charge. He didn’t listen.

I advised him re HRP. He didn’t listen.

Only Waytha listened to me but only whenever he was not in gov’t.

  2. DEI Fernandez,
Hindraf has stood for the rights of all Indians, including Malayalee (Tamilian branchoffs) like you. Wathya is a true hero and true leader of all Indians in Malaysia. Celebrating Thamizhan roots is a good thing for all Indians, and Hindraf should be supported by everyone. Your accusations are baseless. Stop disowning your Thamizhan roots and join Hindraf. Only Hindraf can give all rights. Christian converts like you should never forget your ancestors were Hindus who converted. All Indians are Hindus.

    1. Not all Indians are Tamils. Tamils are confined to Tamil Nadu in southeast India and northern and eastern Sri Lanka.

The rest of India, 90 per cent, is not Tamil.

Don’t make up stories. You can’t claim everything Dravidian is Tamil. That’s Tamil puthi stuff!

Brahui in Baluchistan is also Dravidian.

Tamil broke away from Old Tamil/Dravidian. Tamil is 50 per cent Sanskrit.

What remained became Malayalam which is 75 per cent Sanskrit.

      Malayalam is older than Tamil.

When the people of Kerala became Christian 2, 000 years, there was only sivalingga worship in the south.

In the north Brahma and Vishnu worship.

After the three Gods merged, the Mughal Emperors called it Hindu, a collection of local practices. These practices vary from place to place.

Sanatana Dharma is different but now put under the Hindu label. Tamil Kings, for example, only became Hindu after the merger.

The former priestly class of sivalingga worshippers were declared outcaste (pariah) by the Brahmin.

re religion, Rules must be backed up by principles.

The Quran, for example, is a rule book where no principles are cited.

That’s because they can’t justify their rules.

The Holy Bible, the Word of God, is about the spiritual nature of truth.

      This is self-evident.

      They stand proven.

There’s no need to prove them.

I don’t find the spiritual nature of truth in other religions. No point telling us, “your religion is yours, my religion is mine”.

I am not interested in preachy stuff, only the spiritual nature of truth, otherwise don’t waste my time.

Also, don’t tell me that “God does not exist lah!”

Maybe a God the Creator does not exist.

But personal experience will tell us that “the great spirit in nothingness permeates everything”.

      Otherwise, we won’t be here.

Don’t tell me all Indians are Hindu.

The Constitution guarantees freedom of conscience.

Re Hindraf, tell Waytha Moorthy to contact me.

      Why is he avoiding me?

Who helped him control the Narrative when he was in London and after he returned before joining BN, and after leaving BN?

Before I came in, Putrajaya considered Waytha Moorthy a Tamil Tiger terrorist. I spoke to Foreign Minister Anifah Aman, who was in Cambodia at that time, to return Waytha’s passport to him when he arrives in Singapore en route to Johor Baru for illegal entry.

He avoids me only whenever he’s in Gov’t because during that time, he subscribes to the corruption of the cium tangan cium pantat syndrome. Ask Uthayakumar about this.

It’s okay. I don’t expect people to appreciate me or be grateful.

I only want to make sure that Indians are not misled.

      I can write a book . . .

      HINDRAF Makkal Sakthi

      – I changed the face of a Tamil Tiger terrorist NGO

      by Joe Fernandez

No choice. I don’t want the Indians in Malaya to be misled.
