Anyone can say anything in the court of law. The court knows what to disregard. It will focus on the issues in conflict between the parties in dispute. If the court does not disregard what should be disregarded, then you may be in trouble.

He should return the RM42m and appeal to the court. The Oxford judge pointed out that Najib did not return the RM42m.
If Najib claims “mistrial” in the High Court, without returning the RM42m, he’s taking a big risk.
Anything can happen in court.
If the Court of Appeal accepts there has been “mistrial” in the High Court, the superior court can set aside the lower court ruling and send the case back to the High Court to be heard before another judge, hopefully not one from Oxford, or hear the case itself.
