Novel development in law if Musa Aman returns as Sabah Chief Minister

Praise be to Allah swt for I have been granted leave by the Federal Court today to proceed with my appeal to be declared rightful Chief Minister of Sabah.

Finally, I now have been given the opportunity to fully argue my case at the ultimate court of the land.

The Federal Court has decided that the case against the Sabah TYT and Shafie Apdal is not academic and should be heard so the Federal Court can once and for all ascertain the legality of my dismissal as Chief Minister the subsequent appointment of Shafie as the CM.

The Federal Court is also of the view that the outcome of this case is too significant not just for one individual but for Sabahans in particular and the nation in general.

The people of Sabah have the right to know whether my removal as CM was done in accordance with the Sabah constitution.

That court also stated that this case has legal and constitutional implications at the Federal level.

Like I said before this case is not about me. It is about the fight for the truth, justice and upholding the Sabah Constitution.

I would like to thank my legal team who are fully dedicated to this case and I have faith they will continue to do so moving forward.

I also want to thank my family, friends, political comrades and supporters who have stuck by me all these years.

Syukur ke hadrat Allah SWT kerana saya diberi kebenaran oleh Mahkamah Persekutuan hari ini bagi meneruskan semakan rayuan untuk diisytiharkan sebagai Ketua Menteri Sabah yang sah.

Akhirnya, saya diberi peluang untuk membicarakan kes saya secara sepenuhnya di peringkat mahkamah tertinggi.

Mahkamah Persekutuan mengambil ketetapan bahawa kes terhadap TYT Sabah dan Shafie Apdal bukan bersifat akademik, justeru wajar diperdengarkan supaya Mahkamah Persekutuan dapat menentukan keabsahan langkah menolak saya sebagai Ketua Menteri, susulan pelantikan Shafie sebagai penyandang jawatan berkenaan.

Mahkamah Persekutuan juga mengambil pendirian bahawa dapatan daripada kes ini adalah sangat signifikan, bukan hanya melibatkan seorang individu tetapi untuk semua rakyat Sabah khususnya dan negara amnya.

Rakyat Sabah mempunyai hak untuk mengetahui sama ada langkah penyingkiran terhadap saya sebagai Ketua Menteri dibuat selaras Perlembagaan Sabah atau sebaliknya.

Mahkamah juga menyatakan yang kes ini mempunyai implikasi perlembagaan dan perundangan di peringkat Persekutuan.

Seperti saya nyatakan sebelum ini bahawa kes ini bukan berkisar mengenai diri saya. Ia adalah berhubung perjuangan menuntut kebenaran, keadilan dan memartabatkan Perlembagaan Sabah.

Saya ingin menzahirkan penghargaan kepada pasukan perundangan saya yang memberikan dedikasi sepenuhnya terhadap kes ini dan saya yakin bahawa mereka akan terus berbuat demikian pada masa depan.

Saya juga ingin berterima kasih kepada keluarga, sahabat, rakan seperjuangan politik dan penyokong yang kekal berdiri teguh dengan saya selama ini.

Some things are beyond the Constitution, conventions, law and the court. No court will go against a head of state who does not remain above the fray.

It’s important for heads of state to remain above the fray so that we can maintain political stability to help the economy, shut down unnecessarily by paranoia over hospitalisations, to recover.

The head of state should have remained above the fray on 12 May 2018 and 30 July 2020 but unfortunately didn’t.

If the state assembly could be dissolved on 30 July 2020, it could have been dissolved on 12 May 2018.

MA did not request for an audience to present the so-called 33 SDs mentioned in the media.

MA has said it was not about him but the sanctity of the Sabah Constitution. He accepts that he may not be CM again.

The FC can set aside the CoA ruling on the grounds that there were errors in facts and errors in law.

The court can say that the merits of the case should have been heard, notwithstanding the letter from the state assembly secretary, on the grounds that it could not be considered that MA had automatically resigned when he purportedly lost his majority and a new CM was appointed.

If MA was supposed to resign, and the Governor withheld consent for the dissolution of the state assembly, the matter should have been considered by the state assembly as the proper forum.

Only a lawful CM can advise and request the Governor to consent to the dissolution of the state assembly.

The Federal Court may not rule that MA was automatically sacked when he purportedly lost his majority and SA was appointed.
