The Doctrine of Separation of Powers decides.
Parliament passes laws but only the court can declare them.
The court declares laws by interpreting the intention of Parliament and the framers of the Constitution.
The court affirmed the Constitution.
The court should have just cited the Doctrine of Separation of Powers and asked the Applicant to withdraw his Petition or risk paying heavy costs.
There’s no need to cite the Constitution.

A Sikh in Malaysia was telling me about his two sisters in America who became Christian.
He too became Christian after he learnt about his sisters but remains on the Committee of a Sikh Gurdwara in Kuala Lumpur.

He never attended mass held in St John’s Cathedral, next to St John’s Institution, on certain days in a month.

Spirit of the law . . .
In looking for the spirit of the law and pointing it out for the court to find and declare it, we are inspired by eternal laws based on eternal truths i.e. the Word of God.
These have a spiritual nature.
Western civilisation . . .
The power, energy and discipline of western civilisation comes from Judeo-Christian traditions including the Word of God and the rule of law.
In the rule of law, the basis of the Constitution, there’s greater emphasis on the spirit of the law, read with the letter of the law.
The letter of the law, by itself, isn’t law at all.
Word of God does not mean that God came down and said something.
Word of God refers to eternal laws based on eternal truths.
All the laws of science are Word of God.
Jesus . . .
Jesus explained Truth (emanicipation), Faith (seeing things which can exist) and Karma (The Parable of the Sower on the Law of Cause and Effect).
Karma is the 1st eternal law based on an eternal truth.
What others do to us is their Karma.
How we react is our Karma.
Truth combined with Faith and Commitment (not giving up) takes us to our destination.
Jesus said, “if you have Faith, even though it be as tiny as a grain of mustard seed, “you can say to this mountain, ‘uproot thyself and plant thyself in the sea’ and it would obey you”.
Jesus was not talking about religion, God, or belief in God.
He was explaining Man as Spirit. Man has a spiritual — seeking freedom through Truth — nature.
Jesus said, “you shall know the Truth and the Truth shall set you free”.
“The Truth, once it emerges, cannot be hidden.”
“It will be shouted from the rooftops.”
The Truth has a lifeforce of its own. Once it emerges, it must come into fruition.
Jesus said that “for those who have more, more will be given to them”.
“For those who have little, even the little that they have will be taken away from them”.
These are eternal laws based on eternal truths i.e. the Word of God.
They show that we are here to serve others. The more we give, the more we will get. The more we keep for ourselves, the more it will be taken away from us.
The undifferentiated consciousness — Spirit in nothingness — is in us as differentiated consciousness.
When the gross human body returns to Mother Nature on Mother Earth, there’s no longer any differentiation.
Only the undifferentiated consciousness remains.
The Spirit is one.
Body . . .
The gross human body will return to Mother Nature when it’s time on Mother Earth runs out. It will not be born again. The descendants are related to their parents by two sex cells, each having 23 chromosomes.
China . . .
China, which does not subscribe to the rule of law, rejects the rules-based international order.
International law is based on international customary practices on human rights.
China claims that this Order was created by the west and asks, “what are these rules? Why should we follow them? We have our own ways!”
That’s why China claims the South China almost in its entirety, insists on unilaterally demarcating India’s border with Territories occupied by Beijing, violates intellectual property rights and indulges in technology theft.
Like Islam, China rejects human rights.

In law, there can be no discrimination.
Discrimination is a violation of human rights. Human rights remains the basis of international law. International law is based on international customary practices.

The University of London tells law students, “we will first mark you for the English language, next evidence of wide reading, and finally for the ability to think like a lawyer”.

“No one knows. We will only know when we see it. The proof of the pudding is in the eating.”

Malay not for law . . .
Bahasa Malaysia, based on Bahasa Melayu, words from local languages and dialects, has only 40K words. Check Kamus Dewan. Kamus and Dewan are Sanskrit words.
Bahasa Melayu has only 20K words.
Bahasa Melayu was created by Hindu and Buddhist from southeast India as lingua franca for the Archipelago. Hence, the term Malay Archipelago.
It was used in trade, missionary activities, education and administration.
Bahasa Melayu is based on a Cambodian dialect. Tamil, Sanskrit, and Pali were superimposed on this.
Pali is a Sanskrit dialect used in Buddhist scriptures. Sumatra was one of the learning centres for Sanskrit and Buddhism.
Sanskrit is used in Hindu temples.
Originally, Malay was written in Indian script.
When Islam came to the Archipelago, brought from India, Jawi derived from Farsi and Arabic was used. Farsi and Arabic words crept into Malay.
Farsi is a sister language of Sanskrit.
After western colonialists came to the Archipelago, Malay was written in Roman (Rumi) letters.
The English language, which has 42 sounds, uses the Roman letters which has only 26 sounds.
Malay has 24 sounds and is written in the baku format i.e. written as spoken. So, English words in Bahasa Malaysia are written as spoken.
English isn’t written as spoken.
Under Article 152, Bahasa Melayu — based on the Johor-Rhio-Lingga version — written in Jawi and Rumi is the Bahasa Kebangsaan.
Bahasa Malaysia isn’t the Bahasa Kebangsaan.
Law ceases to exist . . .
Beyond law in court, and that enforced by the authorities, law may not exist although they exist, albeit on paper.
Law ceases to exist, as if it never existed and if it exists ceases to exist, when it’s bad law, cannot be enforced, or isn’t enforced.
There must be law before there can be crime.
No law, no crime.
The principle that there must be no crime or punishment except in accordance with fixed, predetermined law, finds its Latin expression as nullum crimen sine lege, nulla poena sine lege.
Loopholes and lacuna (gaps) in law are a different matter.
They are even more important than law.
Opinion isn’t law.
Only the court can declare law.
God, according to jurisprudence, isn’t a source in law.
Law must have source to have jurisdiction, authority and power.
The court is only about law.
The court isn’t about ethics, moral values, theology, sin, God, justice or truth.
Money laundering . . .
Money laundering cases, for example, are by civil action.
It they are challenged, criminal cases would be instituted.
In law, those who accuse must prove it.
International law has defined the evidence of money laundering as having assets far in excess of what can be legitimately accumulated during a lifetime.
Such assets can be frozen, seized and forfeited by the state by civil action.
Political term . . .
The rule of law isn’t a legal term, it’s political.
The Constitution isn’t law but as the ultimate political document, setting out the governing institutions of state, it has force of law and hence emerges as the supreme law of the land.
Force of law and law aren’t the same.
Force of law is similar to Adat — customary practices — international law (customary international practices on human rights), customary and industry practices and even a Company’s own internal procedures and practices which don’t violate law, and administrative laws (not law at all but subject to judicial review).
The spirit of the law is always read with the letter of the law.
Based on what CJ Richard Malanjum said in his Farewell Address not so long ago, it can be implied that the legal fraternity and the court are often unable to go beyond the letter of the law.
